Activity description

Mediation in society is a conflict resolution process that aims to facilitate communication between the parties involved. It is often used in various contexts, such as labor relations, family conflicts, and commercial disputes. This process allows for reaching mutually acceptable solutions without resorting to lengthy and costly legal proceedings.

Goals

  • Facilitating dialogue: Allowing the parties to express themselves and listen to each other's concerns.

  • Preserving relationships: Helping to maintain positive relationships between the parties, even after a conflict.

  • Save time and costs: Reduce legal fees and the time spent resolving disputes.

  • Promoting autonomy: Encouraging parties to find their own solutions adapted to their situation.

Process

  1. Preparation: The parties are informed of the process and rules of mediation.

  2. Opening: The mediator presents the framework of the mediation and the roles of each party.

  3. Expression of needs: Each party has the opportunity to share their concerns and needs.

  4. Exploring solutions: The parties work together to identify possible solutions.

  5. Agreement: If a consensus is reached, an agreement is formalized in writing.

Benefits

  • Confidentiality: Mediation discussions are generally confidential, which encourages honesty.

  • Flexibility: The process can be adapted to the specific needs of the parties.

  • Commitment: Solutions found through mediation are often better accepted and respected by the parties.
